Can a brand new air conditioner leak oil if turned on it's side?

I recently purchased a new a/c and when I opened the box it was leaking oil. I did have the box on it's side when I was waiting to be picked up. We installed the unit and now it is only blowing warm air and not cold. Does this leaking oil have anything to do with this and if so can the unit have a chance of still functioning? Can a brand new air conditioner leak oil if turned on it's side?
There is something very wrong because there is no way oil should be able to come out of a sealed system. The compresser and related components are hermetically sealed to keep the freon and oil inside. Something is apparently physically broken to let oil escape. No, it will never function. Can a brand new air conditioner leak oil if turned on it's side?
Air conditioning compressors SHOULD NEVER be turned on their side. The oil leaks out of the compressor into the coil or the condensor, but out of the compressor. Sometimes the oil will go back to the compressor. If not, the unit is shot. Try to take it back.
